Bluff Mountain Acres - Section 2
Rising Fawn Way Road Repairs
Dear Property Owner,
As fellow owners in Bluff Mountain Acres Section 2, I am writing to you regarding the condition and maintenance of Rising Fawn Way, which serves all of our properties. A group of owners has begun working together to plan improvements, and we would like to invite you to participate.
Our subdivision has a recorded Declaration of Restrictions that applies to every lot in Bluff Mountain Acres Section 2. These restrictions run with the land and bind all current and future owners. Among them is a clear requirement:
“By accepting delivery of a deed to a lot in Bluff Acres … the Grantees are hereby deemed to covenant and agree to pay their pro rata share of all expenses incurred for the maintenance of the joint permanent roads and streets within the described tract.”
It also provides that:
“Computation of the pro rata share of expenses shall be determined by multiplying the total amount of the expense by the number of lots in the subdivision … No repairs or improvements to said road shall be initiated without the written approval of the majority of property owners.”
In other words, every lot owner has both the obligation to share in road expenses and the right to be part of decisions about improvements.
Since Rising Fawn Way is currently in poor condition, we believe now is the time for owners to come together and take action. This is especially critical because many—if not most—of the properties in Bluff Mountain Acres Section 2 are operated as short-term rentals. Road conditions directly impact guest safety, satisfaction, reviews, and ultimately the success of our rental businesses and the long-term value of our neighborhood.
